协助查询，冻结，扣划存款法律风险防范

　　当前，随着经济案件的逐年增加，司法和行政机关在办案过程中要求信用社协助查询、冻结、扣划客户存款的现象也越来越多。在协查过程中，信用社不仅承担了法律上所要求的责任义务，同时也相应承担了很大的法律风险，如果没有正确履行义务和职责，其直接后果就是对司法、行政机关和存款客户承担法律责任、行政责任、经济责任。笔者现就协查过程中的遇到的几个问题，作个归纳分析，供大家在工作中参考。

　　一、可能的法律风险状况

　　1、注意申请协助机关的权限范围

　　根据现行有效的法律和行规, 对各有权单位查询、冻结、扣划单位或个人存款的权限作了明确规定：A、有权对单位、个人存款进行查询、冻结、扣划的单位有：人民、税务机关、海关;B、有权对单位、个人存款进行查询、冻结的单位有：人民、机关、机关、保卫部门、监狱、走私犯罪侦察机关、证券监督管理机构;C、有权对单位、个人存款进行查询的单位有：工商行政管理机关、监察机关、价格主管机关、人民银行、银监会及省一级银监局;D、有权对单位存款进行查询的单位有：县以上审计机关、保险监督管理机构。

　　2、注意协助执行标的范围

　　对同一标的(存款账户资金)有不同权利主体要求协助执行时，应遵循轮候查封、冻结、扣划原则。工作人员应告知后申请单位，此账户已被冻结的相关情况。先予申请冻结的单位对申请冻结金额内有优先扣划权，后申请单位只有在先申请单位对标的执行后或执行范围之外的标的有执行权。这也有例外，按破产法规定：当企业破产后，其已判决未被执行财产的，应中止执行;未判决的案件应当移送受理破产申请的。因此，当标的存款企业被宣告破产后，除受理破产案件的外，其它部门不得再扣划此单位存款。

　　3、注意据以执行的通知书和法律文书

　　根据最高人民、中国人民银行等国家机关的规定，金融单位对协助执行通知书相关内容应要进行审查，包括开户金融机构名称、客户名称、账号是否正确，金额大小写是否相符、划入账户是否属专用账户，相关文字有无涂改现象。原则上要求提供协助执行通知书原件，若提供的是复印件应要求其在复印件上盖公章。有权机关可要求冻结客户存款的最长期限为6个月，6个月期满后自动解冻。冻结期满前可以申请续冻，续冻期限只有3个月，法律对续冻次数没有。对要求扣划客户存款的，工作人员应要求其提供生效的法律文书(判决书、裁定书、先予执行裁定书)。扣划的款项应转入专用账户，不得进行提现。需要指出的是, 上述各种“通知书”均必须经县级(含)以上人民、人民、机关等机关的公函形式出具, 并加盖该司法机关公章。

　　4、其他注意事项

　　有些存款账户具有特殊性质，应区别对待。证券经营机构的非自营账户，由于其属于客户清算保证金，不是属于证券经营机构的自有资金，因此不能对其冻结、扣划;信用证、承兑汇票保证金可以冻结，当它不再具有保证金功能时才可以扣划;封闭贷款结算专户，不得冻结、扣划;企业工会经费，不得冻结、扣划。

　　有权单位查询、冻结、扣划客户存款后，工作人员应告知客户其账户的有关情况，但不得在业务办理期间给客户通风报信。

　　二、防范风险的小建议

　　1、学习法规，加强依法协助。员工要加强学习银行金融法规，做到执法来时了然于心，对法律细则规定拿得出手用得上。凡是符合法规的协查，应予以支持，及时协助;凡是不符合协查法规的程序，决不予以支持。

　　2、及时整改检查，完善防范机制。通过自查自纠，摸清协查过程中不规范操作行为，在维护信用社知情权和利益情况下，采取恰当的补救措施。建立内部规范条例，做到协查操作程序化、细化，员工规范有序，赏罚分明。

　　3、维护金融秩序，排除侵权干扰。在实际办理业务时，存在种种不规范甚至违法的做法，有些司法、行政机关手续不全，缺少有效执行文书，或有冒充司法行政机关人员，持假冒文书来要求协查，这既是对信用社的不尊重，也是对法律的藐视。建议银行联手，出台有关单位合作程序机制，做到交流协商，维护金融秩序，排除侵权干扰，确保信用社财产资金安全。
